Terms of Service

By accessing or using DiamondOps (“the Service”), operated at diamondops.gg, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not access or use the Service. These Terms constitute a legally binding agreement between you and RetroGhostLabs (“we,” “us,” “our”).

DiamondOps is a market intelligence, analytics, and portfolio tracking platform for MLB The Show Diamond Dynasty. The Service provides card pricing data, market trend analysis, flip opportunity identification, OpScore analytics, portfolio tracking, and related tools and games.

DiamondOps is NOT affiliated with, endorsed by, or sponsored by Sony Interactive Entertainment, San Diego Studio (SDS), Major League Baseball (MLB), the Major League Baseball Players Association (MLBPA), or the MLB The Show franchise. All game data, card names, player names, player likenesses, and related imagery are the property of their respective owners and are used for informational and fan purposes only.

You may create an account using Sign in with Apple or Sign in with Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

The Service offers multiple subscription tiers (Free, Lite, Pro, and Diamond) at prices displayed on the upgrade page. Paid subscriptions are billed through Stripe on a recurring monthly basis. By subscribing, you authorize Stripe to charge the applicable fees to your payment method. Prices are subject to change with notice.

You may cancel your subscription at any time. Upon cancellation, you retain access to paid features until the end of your current billing period. No partial refunds are issued for unused portions of a billing period. We do not provide prorated refunds for any reason.

You may request permanent deletion of your account and all associated data at any time from your account settings page. Deletion requests enter a 7-day grace period during which you can cancel and restore your account. After the grace period, all data is permanently removed and cannot be recovered. Active subscriptions are cancelled immediately upon deletion confirmation, and no refund is issued for any unused subscription time.

Notify us immediately at support@diamondops.gg if you suspect unauthorized access to your account.

You agree not to engage in any of the following activities:

• Scrape, crawl, spider, or bulk-download any data or content from the Service
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service or its underlying algorithms
• Access or attempt to access the Service's API without explicit authorization, or exploit any undocumented API endpoints
• Circumvent, disable, or interfere with rate limits, usage quotas, or other technical restrictions
• Share, transfer, sell, sublicense, or resell your account credentials or access to any other person or entity
• Use bots, scripts, automated tools, or any programmatic means to access the Service without prior written permission from RetroGhostLabs
• Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure
• Use the Service in any way that violates applicable local, state, national, or international law or regulation
• Reproduce, redistribute, or publicly display data obtained from the Service for commercial purposes without authorization
• Create derivative works or competing services based on data obtained from the Service

The following conduct is strictly prohibited and may result in immediate termination:

• Attempting to hack, exploit, or probe for vulnerabilities in the Service or its infrastructure
• Attempting to access, view, modify, or obtain any other user's data, account, or personal information
• Circumventing, bypassing, or disabling any security measures, authentication mechanisms, or access controls
• Deploying or distributing malware, viruses, or any other malicious code through or against the Service
• Conducting denial-of-service attacks or any action intended to degrade the Service's availability
• Using bots or scripts to manipulate, game, or exploit any feature of the Service, including leaderboards, games, or market data
• Impersonating another user, person, or entity

RetroGhostLabs reserves the right to immediately suspend or terminate your account, without prior notice or warning, and without issuing any refund, for any violation of these Terms.

We are under no obligation to provide advance notice, explanation, or a grace period before taking enforcement action. Violators may be permanently banned from the Service. All enforcement decisions, including suspension, termination, and banning, are made at our sole and absolute discretion and are final. No recourse, appeal process, or review is guaranteed.

We also reserve the right to terminate or suspend any account at any time for any reason, including but not limited to inactivity, suspected fraud, or business decisions, with or without cause.

All market data, pricing information, OpScores, flip suggestions, trend analyses, rankings, and other analytics provided by the Service are for informational purposes only. The Service does not provide financial advice, investment advice, or trading recommendations of any kind.

DiamondOps makes no guarantees, representations, or warranties regarding the accuracy, completeness, timeliness, or reliability of any data or analytics. Market data may be delayed, incomplete, or inaccurate. OpScores, suggestions, rankings, and trend indicators are algorithmic estimates based on available data and are not guarantees of any outcome.

You are solely responsible for any decisions you make based on information from the Service, including in-game actions such as buying, selling, or trading cards. RetroGhostLabs accepts no liability whatsoever for losses, missed opportunities, or unfavorable outcomes resulting from reliance on the Service's data or recommendations.

All content, branding, software, code, design, and other intellectual property comprising the Service is owned by RetroGhostLabs and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

Card names, player names, player likenesses, team logos, game data, and related imagery from MLB The Show are the property of Sony Interactive Entertainment, San Diego Studio, MLB, MLBPA, and their respective owners. Such materials are used under fair use principles for informational and fan purposes only.

DiamondOps is currently in an Early Access phase. During Early Access, the Service is provided strictly on an “as-is” basis with the following additional conditions:

• The Service may be interrupted, degraded, or unavailable without advance notice
• Features may be added, modified, or removed at any time without prior notice
• Subscription pricing and tier structures may change
• No uptime, availability, or performance guarantees are provided
• Data formats and API behavior may change without backward compatibility

All accounts and data created during Early Access will be retained when the Service transitions to general availability.

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. RetroGhostLabs expressly disclaims all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that the results obtained from using the Service will be accurate or reliable.

To the maximum extent permitted by applicable law, in no event shall RetroGhostLabs, its owner, affiliates, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service.

In no event shall the total aggregate liability of RetroGhostLabs exceed the total fees you have paid to RetroGhostLabs in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty dollars ($50), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless RetroGhostLabs, its owner, affiliates, officers, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any intellectual property or other right of any person or entity.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court.

You and RetroGhostLabs agree that any arbitration shall be conducted on an individual basis only, and not as a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in the State of Maryland.

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of the Service after any changes constitutes your acceptance of the modified Terms.

For material changes that significantly affect your rights or obligations, we will make reasonable efforts to notify you via email or an in-app notification prior to the changes taking effect.

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RetroGhostLabs regarding your use of the Service, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
